alright i need some help please...

running on a single GTX 680. ran the patch (not full) then rebooted. checked to make sure it patched and it said 'already patched', so i activated Test Mode, then rebooted. no watermark. did this twice. i tried to OC my refresh rate anyway and it didn't work as i expected.

not sure what i'm doing wrong... ?

I would reload the patch. Make sure you follow the instruction on the web site or look at Overlord Computer's video. He explains it very well and you need to follow it carefully. Nothing is fool proof, but the patch does work. I am running two GTX 670 in SLI. Make sure you follow the CRU set-up correctly and you have designated a 120 hz option as your first selection.

ok so i think i have it working (possibly)

i re-patched and re-enabled Test Mode, rebooted (but i still have no watermark)

used CRU for a 96hz reso., rebooted then through the nvidia control panel 96hz was available. so does this mean it's working? is there any way to tell if i'm really at 96hz ?

Does it still work after rebooting? If so, test mode is working. Some people don't get the watermark for some reason. If test mode wasn't working, then the patched driver wouldn't load and the NVIDIA control panel wouldn't be available.

If you can add 2560x1440 @ 96 Hz with CRU, then the patched driver is loading and working correctly.

also can i update my drivers to the new 320.49 and use the same patcher?

I haven't tested 320.49, but it finds all the limits, so it should work.

I have downloaded the new drivers from Nvidia. Unfortunately, I have to set the native hz to 60 in order to launch Modern Warfare-Warfighter or it crashes. I can use 88 hz to play World of Tanks. Before I downloaded the new drivers, I was able to launch at 88 hz. However at 60 hz, when I get into the game, it is running at 120 hz and the game is very sharp and clear. I have not been able to launch into Modern Warfare at a native 120 hz ever. I don't know if it has something to do with Origins or not, but that is what seems to be causing the problem. Wanted to pass this issue along in case others are experiencing it.

Are you using CRU or are you using the NVIDIA control panel to add the refresh rates?
